Terms and definitions

 

 

  1. Subject matter

    1. Subject matter of the Agreement is provision of a possibility to the User to purchase Products provided in the online store catalogue at the address: https://rusmods.com for their personal, family, household and other needs.

    2. Present Agreement covers all types of Products and services provided on the Web site until such offers with description are shown in the online store catalogue.

 

  1. Registration on the web site

    1. Registration on the web site is done in the corresponding section “Registration”.

    2. Registration on the web site is not mandatory for placing an Order.

    3. Online store bears no responsibility for the accuracy of information provided by the User during registration.

    4. The User undertakes to not provide third persons with the login and the password specified by the User during registration. In case the User has suspicions regarding the safety of their login and password or the possibility of an unauthorized use of the login and password by third persons, the User undertakes to immediately notify the administration of the online store by sending an e-mail using the feedback form in section “Feedback”.

 

  1. Shopping procedure

    1. In case of an absence of the Products ordered by the Buyer in the Seller’s warehouse, the latter has the right to exclude the specified Products from the Order/cancel the Buyer’s Order having notified the Buyer about it by sending a corresponding e-mail to the address, specified by the Buyer during registration.

    2. In case of a full or partial cancellation of a prepaid Order, the cost of the cancelled Product is returned by the Seller to the Buyer using the same method the Product was paid with.

    3. The Buyer’s Order is placed in accordance with procedures specified on the Web site in section “Order placement”.

    4. The Buyer bears full responsibility for the provision of false information, which leads to the impossibility for the Seller’s proper fulfillment of their obligations to the Buyer.  

    5. After placing the Order on the Web site, the Buyer is provided with information about the expected delivery date in an e-mail sent to the address, specified by the Buyer during registration.

    6. The Product transfer date can be changed by the Seller unilaterally due to the objective reasons in the opinion of the Seller.

 

  1. Order delivery

    1. Delivery methods and expected delivery dates for the Product are specified on the Web site in section “Delivery methods”.

    2. The Product delivery dates depend on the selected delivery method and the work of the post service.

    3. The Seller guarantees confidentiality and protection of the Recipient's personal information.

    4. Risk of accidental loss or damage of the Product is imposed on the Buyer as of the moment the Order is handed over to them. In case of a failure to deliver the Order, the Seller will compensate the Buyer with the Buyer’s prepaid cost of the Order and the cost of delivery in full after receiving the confirmation of the lost Order from the Delivery service

    5. The cost of delivery of each Order is specified on the Web site at the last stage of Order placement.

    6. The Seller’s obligation to transfer the product to the Buyer is considered fulfilled as of the moment the Recipient receives the Product in the post office.

    7. The User understands and agrees with the following: provision of delivery is a separate service, which is not an integral part to the Product purchased by the Buyer, provision of which ends as of the moment the Buyer receives the Product and pays for it. Claims regarding the quality of the purchased Product, which arose after the Product was received and paid for, are considered in accordance with the RF Law “On protection of consumer rights” and warranty obligations. In this respect, the purchase of the Product with delivery does not provide the Buyer with the right to claim the delivery of the purchased Product for the purposes of the warranty service or replacement, does not imply the possibility of the Product delivery cost refund in cases where the Buyer has the right for the refund for the Product as such according to the RF Law “On protection of consumer rights”.

 

  1. Payment for the product

    1. The product prices are shown in Russian rubles for the Buyers from the Russian Federation and in US dollars for the citizens from other countries.

    2. The citizens of the Russian Federation can pay for the products in Russian rubles only.

    3. The prices in rubles and US dollars for the same product may differ with direct currency conversion and are set at the discretion of the Seller.

    4. The price for the Product on the Web site can be changed by the Seller unilaterally. However, the price for the Product ordered by the Buyer  is not subject to change.

    5. Aspects of payment for the Product using bank cards

    6. According to the provision of the Central Bank of the Russian Federation ”On the issuance of bank cards and transactions carried out using payment cards” dd. 24.12.2004 N 266-П, transactions using bank cards can be carried out by the card holder or a person authorized by them.

    7. Authorization of bank card transactions is carried out by the bank. In case the bank has suspicions about the transaction being fraudulent, the bank has the right to refuse provision of such transaction. Fraudulent transactions with bank cards fall within the scope of the article 159 of the Criminal Code of the RF.

    8. In order to avoid all sorts of illegal use of bank cards for payment, all Orders, placed on the Web site and prepaid with a bank card, shall be checked by the Seller. For the purposes of confirming the identity of the card holder and their authority to use the card, the Seller has the right to claim from the Buyer, that placed such order, to provide a document confirming their identity.

    9. The Seller has the right to provide discounts for the Products and arrange a bonus program.

 

  1. Return of the product and refund

    1. Return of the Product sold in the online store is done according to the “Return terms”.

    2. Return of the Product of proper quality:

      1. The Buyer has the right to refuse from the ordered Product at any time before it is received and within 14 days from the moment it was received. Return of the Product of proper quality is possible in case if the Product’s appearance, consumer properties are kept and in case of presence of a document confirming the fact and terms of purchase of the specified Product.

      2. In case the Buyer refuses from the Product according to the par. 7.2.1, the Seller refunds the cost of the returned Product for the exception of the expenses of the Seller associated with delivery of the returned Product within  7 days from the moment the returned Product is delivered to the Seller’s warehouse together with the Buyer’s filled-in refund request.

    3. Return of the Product of inadequate quality:

      1. Product of inadequate quality is product, which is faulty and cannot provide its functional properties. The received Product shall correspond to the description on the Web site. Design elements or decor, which are different to what is described on the Web site, is not a sign of an inadequate quality.

      2. Appearance and completeness of the Product, as well as the completeness of the whole Order shall be checked by the Recipient as of the moment of delivery of the Product.

      3. As requested by the Buyer, the product of inadequate quality can be replaced with identical product and in case it is impossible for the Seller to satisfy such request, the Buyer has the right to claim the refund of the paid amount for the product according to the par.7.3.5.

      4. If the Buyer was supplied with the Product of inadequate quality and this was not specified by the Seller, the Buyer has the right to use provisions of the article 18 “Consumer rights in case of detection of defects in product” of the Law on protection of consumer rights.

      5. The requirement to refund the amount paid for the product shall be satisfied within 10 days from the moment such requirement was presented (article 22 of the RF Law “On protection of consumer rights”).

      6. The refund is returned by the Seller using the same method the Product was paid with.

 

  1. Responsibility

    1. The Seller bears no responsibility for the damage caused to the Buyer due to the improper use of the Products purchased in the online store.

 

  1. Information confidentiality

    1. Personal information about the User/Buyer is processed according to the Federal Law “On the personal information” № 152-ФЗ.

    2. The User provides the following information during registration on the Web site: Last name, Name, Patronymic name, telephone number, e-mail address, date of birth, gender, the product delivery address.

    3. By providing the Seller with personal information, the User/Buyer agrees for their processing for the purposes of fulfillment of the Seller’s obligation to the Web site Visitor/User/Buyer under the present Public offer, for the purposes of the Seller’s promotion of the products and services, execution of electronic and sms surveys, for control over the results of the marketing actions, for provision of the client support, for arrangement of the product delivery to the Buyer,  for the prize drawing among the Visitors of the Web site/Users/Buyers, for checking the satisfaction of the Visitor of the Web site/User/Buyer as well as for control over the quality of services provided by the Seller.

    4. Processing of the personal information means any action or set of actions with the personal information carried out with or without the use of the automated equipment including collecting, recording, systematization, storage, clarification (updating and modification), extraction, use, transfer (including transfer to third persons, not excluding the trans-border transfer in case the need in it arose during the fulfillment of obligations), depersonalization, blocking, deleting, destruction of personal data.

    5. The User/Buyer can demand at any time for their personal information to be deleted having sent a written request for the deleting of the personal information via the personal account.

    6. All mailouts using the personal data are carried out only in case of corresponding settings in the Personal account of the User/Buyer.

 

  1. Validity period of the public offer

    1. Present Public offer comes into force from the moment it is accepted by the User/Buyer and is valid through to the withdrawal of the acceptance of the Public offer.

 

  1. Additional terms

    1. The Online store and provided services may be temporarily unavailable fully or in part due to the provision of maintenance or other works or due to other technical reasons. Technical support team has the right to carry out required maintenance or other works from time to time with or without notification of the Buyers.

    2. Provisions of the Russian legislation are applied to the relations between the User/Buyer and the Seller.

    3. In case of questions and claims from the User’s/Buyer’s side, they undertake to address to the Seller by the phone or using other available means. The parties will try to solve all arising issues by means of negotiations; in case no agreement is reached, the dispute shall be considered by the judicial authority according to the applicable legislation of the RF.

    4. In case if the court declares any provision to be invalid, it does not lead to invalidation of the remaining provisions.
